How Singapore tenancy stamp duty works
Stamp duty on a lease is charged at 0.4% of the total rent for the lease period. The total rent is the average annual rent multiplied by the number of chargeable years, and average annual rent includes anything else you pay the landlord β service charge, maintenance, furniture.
Leases of four years or less are charged on the full term. Anything longer, including indefinite or renewable leases, is capped at four years. If average annual rent is S$1,000 or below, nothing is payable.
The part that catches people out is the deadline. You have 14 days from signing (30 if signed outside Singapore). Miss it and there is a penalty β but the bigger problem is that an unstamped agreement cannot be used as evidence in court. If the deposit is withheld or the rent is disputed, that is exactly when you need the document to count.

- Stamp duty is 0.4% of the total rent for the lease period. Total rent is the average annual rent multiplied by the number of years. For a one-year lease at S$3,000 a month, the annual rent is S$36,000 and the duty is S$144.
- Who pays stamp duty on a tenancy agreement, the landlord or the tenant?
- By convention in Singapore the tenant pays the stamp duty, though the tenancy agreement can assign it differently. IRAS holds the parties to whatever the agreement says.
- How long do I have to stamp a tenancy agreement?
- You must stamp within 14 days of signing if the document is signed in Singapore, or 30 days if it is signed overseas. Late stamping attracts a penalty.
- What happens if a tenancy agreement is not stamped?
- An unstamped agreement cannot be admitted as evidence in court. If a dispute over rent, deposit or damage ends up in front of a judge, an unstamped tenancy agreement is of little help to you. IRAS may also impose a penalty on late stamping.
- Is stamp duty charged on a lease longer than four years?
- Leases of more than four years, and leases that are indefinite or renewable, are capped at four years for stamp duty purposes. A ten-year lease pays the four-year equivalent, not ten years.
- Do service charges and furniture count towards stamp duty?
- Yes. Average annual rent includes other consideration paid to the landlord, such as service charge, maintenance fees and payment for furniture and fittings. Leaving these out is the most common way people under-declare.
- Is there a minimum rent below which no stamp duty is payable?
- If the average annual rent is S$1,000 or below, no stamp duty is payable.
