The rules that catch people out

The consequences here are not small. Renting out an HDB flat before MOP, without registering the rental, or in breach of the quota is a breach of the lease. HDB can impose a financial penalty or compulsorily acquire the flat. This is the one part of renting direct where being casual is genuinely expensive.

The rule most people miss is the Non-Citizen Quota. It is not a property-level rule β€” it depends on how many non-citizen households are already renting in your neighbourhood and your block, which changes over time. Malaysians are exempt. Everyone else counts. You can find a tenant, agree terms, and still be refused because your block is full.

The second is the Permanent Resident whole-flat rule. PRs simply cannot rent out an entire flat, only rooms, and must keep living there. There is no application or exception for this.

How long must I own my HDB flat before renting it out?
You must complete the Minimum Occupation Period of 5 years from the date of key collection. Flats bought before 30 August 2010 without a housing grant have a shorter 3-year MOP. Renting out before MOP is a breach, and HDB can compulsorily acquire the flat.
Can a Permanent Resident rent out a whole HDB flat?
No. Only Singapore Citizens may rent out an entire HDB flat. Permanent Residents may rent out individual bedrooms, but must continue living in the flat themselves.
What is the HDB Non-Citizen Quota?
When a whole flat is rented to a non-citizen who is not Malaysian, the rental is subject to a Non-Citizen Quota of 8% at neighbourhood level and 11% at block level. If your block has reached its quota the rental will not be approved. Malaysians are exempt from this quota.
