Can I Rent My Property to a Work Permit or S Pass Holder?

Yes โ both HDB flats and private property can be rented to Work Permit and S Pass holders. What changes is the paperwork. HDB checks the tenant's pass, its remaining validity, and in some cases their job sector before approving anything. Private property doesn't check any of that: MOM's own guidance states private residential premises are "allowed to house all foreign employees," full stop.
The mistake landlords make isn't renting to the wrong pass type โ it's assuming HDB rules apply everywhere, or missing the one step MOM does ask of a private landlord.
Can I rent to a Work Permit or S Pass holder at all?
Yes, provided the pass is currently valid. Both HDB flats and private residential property (condos, landed housing) may be rented to non-citizens holding an Employment Pass, S Pass, Work Permit, Student Pass, Dependant Pass or Long-Term Visit Pass. The one group that can't rent either type of housing is tourists and social visit pass holders โ HDB states this explicitly, and neither type of property can be used for anyone without a valid basis to stay in Singapore.
Beyond that baseline, HDB and private property diverge sharply.
What are the rules for renting an HDB flat to a Work Permit or S Pass holder?
Three conditions, on top of the usual HDB tenant checks: pass validity, sector, and the Non-Citizen Quota.
Pass validity. The tenant's pass must have at least 6 months' validity remaining as at the date you apply to HDB โ not from move-in, from application.
Sector restrictions apply to Work Permit holders, not S Pass or Employment Pass holders. For a whole flat, HDB requires Work Permit holders from the construction, manufacturing, marine and process sectors to be Malaysian โ a Work Permit alone isn't enough in those four sectors. For a bedroom, the restricted list is narrower: construction, marine and process sector Work Permit holders must be Malaysian, but non-Malaysian Work Permit holders in manufacturing may rent a bedroom (just not a whole flat). MOM's own housing guidance confirms the same split: Work Permit holders qualify for HDB housing if they're Malaysian or work in the services sector, and non-Malaysian manufacturing-sector holders are limited to bedrooms.
The Non-Citizen Quota applies to whole-flat rentals when any tenant is a non-Malaysian non-citizen โ which includes a non-Malaysian S Pass or Work Permit holder. It's 8% at neighbourhood level and 11% at block level, and it's live data that shifts as neighbours rent out. It does not apply to bedroom rentals.

What are the rules for renting private property to a Work Permit or S Pass holder?
Simpler: none of the HDB restrictions apply. MOM states plainly that private residential premises โ condominiums, landed houses, terraces, semi-detached and shophouse units โ are "allowed to house all foreign employees." No sector rule, no pass-type carve-out, no Non-Citizen Quota. A construction-sector Work Permit holder who can't even rent an HDB bedroom can rent a condo unit without issue.
What does apply, per URA, is the same baseline as any private tenancy: a minimum stay of three consecutive months, and an occupancy cap of six unrelated persons per unit. Domestic helpers count as part of the family unit rather than against the cap. Units of at least 90 sqm can register for a temporary relaxation to eight occupants, running from 22 January 2024 to 31 December 2028 โ registration costs S$20 and must be done before you rely on the higher cap.
Do I need to register my tenant with URA or MOM?
Not in the way HDB requires โ but there's one step MOM does ask of you. Private property owners don't register individual tenants with URA. Where MOM gets involved: if this is the first time you're renting your private property to a work pass holder, you're required to log in to MOM's Foreign Worker Tenant Enquiry Service (FWTES) and complete a one-time declaration. After that, no further filing is expected from the landlord for that property.
The address itself is registered by someone else. For a Work Permit holder, the employer registers and updates the residential address through MOM's OFWAS system โ before the Work Permit is issued or renewed, and within 5 days of any change. For an S Pass holder, either the employer or the pass holder updates the address through EP eService, also within 5 days of a change. That obligation sits with the employer or tenant, not the landlord โ your role is providing an address that actually matches your unit, since MOM cross-checks it.

How do I check that a Work Permit or S Pass is genuine and current?
Use MOM's Check a Work Pass e-service or the SGWorkPass mobile app, which lets anyone scan the QR code on a pass card or digital pass to confirm it's valid and current. Don't rely on a photo of the card alone โ a pass that expired last month still looks fine in a photo.
For HDB rentals specifically, HDB also offers its own tenant verification e-service alongside the pass check, since HDB additionally needs to confirm the 6-month validity window and sector before approving the tenancy.
What happens if I rent to someone whose pass has lapsed or was never valid?
For HDB, the application is simply rejected if the pass doesn't meet the validity or sector conditions โ you find out before the tenancy starts. For private property, there's no equivalent gatekeeping step, which is exactly why checking the pass yourself matters more, not less. Can I rent my HDB flat to an S Pass holder? Does the Non-Citizen Quota apply to private property? No. It's an HDB-specific mechanism. Private residential property has no citizenship-based rental quota.
